Dog Breeding Licence - Rother01424 787500Formally, under the Breeding of Dogs Act 1973, a person having two or more breeding bitches needed to have a licence, which is issued annually by the local Council following an inspection of the breeding facilities. However, that legislation contained loopholes which were continually exploited by unscrupulous breeders. On 31 December 1999, a new law came into force. The Breeding and Sale of Dogs (Welfare) Act 1999 was created to stop indiscriminate and irresponsible dog breeding and to improve the standards of those breeding establishments which are licensed. So what constitutes a breeding establishment? Under the new Act, it is clear that anyone producing five or more litters in any period of 12 months must be licensed - in these circumstances, there is now an automatic presumption that the breeder is running a business. However, a breeder in this position will not need to be licensed if they can show that none of the bred puppies were in fact sold by them or any other person. Additionally, breeders will no longer be able to claim that dogs used for breeding belong to friends or relatives. The decision to licence premises rests with the local authority. Some breeders will claim that they are only "hobby" breeders. In these cases, licensing officers must determine whether a commercial "business" is being or is likely to be operated.
